Terms & Conditions

These terms govern your use of AntiquesDirectory.com (“the Service”), operated by Martin Digital Assets LLC (“we,” “us”). By using the Service, you agree to these terms. If you don’t agree, don’t use the Service.

1. Eligibility

You must be at least 13 years old to use the Service and at least 18 to create a business listing, upgrade to a paid plan, or enter into any payment-related agreement.

2. Your account

You’re responsible for keeping your login credentials confidential and for any activity that happens under your account. Notify us immediately if you suspect unauthorized access.

You agree to provide accurate information and keep it up to date. We may suspend or terminate accounts that provide false information, impersonate others, or repeatedly violate these terms.

3. User content

“User Content” includes reviews, forum posts, listing descriptions, photos, and anything else you submit to the Service. You retain ownership of your User Content. By submitting it, you grant us a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute it as necessary to operate and promote the Service.

You agree not to submit content that:

  • Infringes anyone else’s intellectual property.
  • Is defamatory, harassing, threatening, or hateful.
  • Contains false, fake, or paid reviews.
  • Impersonates another person or business.
  • Includes malware, spam, or affiliate links unrelated to the listing.
  • Violates any law.

We reserve the right — but have no obligation — to remove any User Content at our discretion.

4. Business listings

You may add a listing for a real business you own, operate, or have been authorized to represent. We may request verification (EIN, business license, utility bill) and may remove listings that appear to be fraudulent, duplicate, or inactive.

You’re responsible for the accuracy of information in your listing — address, hours, photos, pricing, category, etc. We may update, correct, or remove listing content we believe is materially inaccurate or misleading.

5. Paid plans & billing

Paid plans (Pro, Elite, per-event, and estate-sale plans) are billed monthly or annually as selected at checkout. Subscriptions auto-renew until canceled. You can cancel any time from your account dashboard; cancellation takes effect at the end of the current billing period.

Refunds: monthly subscriptions are non-refundable after the billing date. Annual subscriptions are refundable on a pro-rated basis for unused full months if canceled within 30 days of the charge. Per-event charges are non-refundable once the event is published.

We may change plan pricing with at least 30 days’ notice. Any price change will take effect at the start of your next billing period, and you can cancel before then if you don’t want to continue.

6. Metals buy-offer marketplace

The melt-value calculator lets consumers request buy-offers from dealers. When you submit a request, your details are shared with opted-in dealers who may contact you with offers. We are not a party to any transaction between you and a dealer. We do not guarantee the accuracy of offers, the quality of dealers, or the safety of any transaction. Use common sense when dealing with buyers — meet in public, verify identities, and don’t mail valuables without tracking and insurance.

Dealers who opt in to receive requests agree to contact consumers only about the item described in the request and to comply with all applicable consumer-protection and marketing laws.

7. Third-party services & disclaimers

  • Melt values shown in the metals calculator are estimates based on live spot prices and do not constitute an offer, appraisal, or guarantee of any kind.
  • Directory information (addresses, hours, reviews, etc.) is provided on a best-effort basis. Call ahead before traveling.
  • Third-party offers (including affiliate partners like Square and payment processing via POS Outlet) are subject to the terms of those providers. We may earn a referral fee if you sign up through a link on the Service.
  • Advertising shown via Google AdSense is served by Google and subject to its policies. We don’t endorse advertisers and don’t control ad content on a per-ad basis.

8. Intellectual property

The Service — including its design, code, text, logos, and non-user content — is owned by Martin Digital Assets LLC and protected by copyright and trademark law. You may not copy, reproduce, scrape, or redistribute substantial portions of the Service without our written permission.

If you believe content on the Service infringes your copyright, send a DMCA takedown notice to hello@antiquesdirectory.com including (1) your contact info, (2) the work you claim is infringed, (3) the URL of the infringing content, (4) a statement of good-faith belief that the use is not authorized, and (5) your signature.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT WILL MARTIN DIGITAL ASSETS LLC OR ITS OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE PRIOR TWELVE MONTHS OR (B) ONE HUNDRED U.S. DOLLARS ($100).

10. Indemnification

You agree to indemnify and hold Martin Digital Assets LLC harmless from any claim, loss, or expense (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your violation of these terms.

11. Governing law & disputes

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising under these terms that cannot be resolved informally will be brought exclusively in the state or federal courts located in Rains County, Texas, and you consent to the jurisdiction of those courts.

12. Changes to these terms

We may update these terms as the Service evolves. If a change is material, we’ll update the “Effective” date and (if you have an account) notify you by email. Continued use of the Service after a change means you accept the updated terms.

13. Severability & entire agreement

If any provision of these terms is held unenforceable, the rest remain in effect. These terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service.
